INTERNATIONAL PUBLIC OFFER AGREEMENT

1. GENERAL PROVISIONS AND GOVERNING LAW
1.1. This document constitutes an official public offer of the Chessnok.kz online store, owned by Sole Proprietor Tyulyukina Yu.Sh., registered in accordance with the legislation of the Republic of Kazakhstan in Almaty (hereinafter referred to as the "Seller"), to conclude a Purchase and Sale Agreement under the terms and conditions set forth below.
1.2. In accordance with Article 395 of the Civil Code of the Republic of Kazakhstan (CC RK), this document is a public offer addressed to any individual or legal entity in any country of the world (hereinafter referred to as the "Buyer").
1.3. Full and unconditional acceptance (acceptance) of the terms and conditions of this offer (Article 396 of the CC RK) shall be deemed to be the execution of payment for the Goods (Services) by the Buyer on the website [Insert website link] or the placement of an order. From this moment, the Agreement shall be deemed concluded in writing.
1.4. Governing Law: This Agreement, as well as all relations between the Seller and the Buyer (including matters of its conclusion, performance, termination, and invalidity), shall be exclusively governed by the applicable legislation of the Republic of Kazakhstan, regardless of the citizenship, residency, or location of the Buyer.
1.5. Language of the Agreement: This Agreement is drawn up in the Russian language and in the English language. In the event of any discrepancies or disputes regarding the interpretation of the terms, the Russian version shall prevail.
2. SUBJECT OF THE AGREEMENT AND ORDERING PROCEDURE
2.1. The Seller undertakes to transfer the Goods, and the Buyer undertakes to accept and pay for them under the terms of this Agreement. The characteristics and assortment are specified on the Seller's website.
2.2. The Buyer guarantees that they possess the legal rights and capacity to conclude this Agreement in accordance with the laws of the country of their citizenship and residence.
3. PRICE, CURRENCY, AND PAYMENT PROCEDURE
3.1. Prices for Goods are indicated on the Seller's website in the national currency of the Republic of Kazakhstan and in several foreign currencies.
3.2. If the currency of the Buyer's payment card account differs from the currency of the transaction, the currency conversion shall be performed by the Buyer's or the Seller's issuing bank or the payment system at their internal rate at the time of debiting funds.
3.3. The Seller shall not be held liable for any third-party fees, bank charges, or exchange rate differences arising from the conversion of the Buyer's currency.
4. CUSTOMS DUTIES, TAXES, AND DELIVERY
4.1. Delivery of the Goods is carried out to countries available for selection when placing an order. Delivery times and costs are calculated individually.
4.2. Customs Clearance and Fees: The Buyer shall independently and at their own expense perform customs clearance of the Goods in the country of receipt. The Buyer bears full responsibility for the payment of all import duties, taxes (including VAT of the country of receipt), and other fees established by the legislation of the country to which the Goods are delivered.
5. PROTECTION OF PERSONAL DATA AND CONFIDENTIALITY
5.1. The Seller collects and processes personal data of the Buyer in accordance with the Law of the Republic of Kazakhstan "On Personal Data and Their Protection".
5.2. With respect to Buyers who are residents of the European Union (EU), the Seller takes reasonable measures to comply with the principles of the General Data Protection Regulation (GDPR). The Buyer has the right to withdraw consent, delete data, or restrict its processing by sending a request to the Seller's email.
6. LIABILITY AND RESOLUTION OF INTERNATIONAL DISPUTES
6.1. For non-performance of obligations, the Parties shall bear liability in accordance with the laws of the Republic of Kazakhstan.
6.2. Pre-trial Procedure: All disputes shall be resolved through the mandatory submission of a written claim to the Seller's email address. The term for responding to a claim is 15 (fifteen) business days from the date of its receipt.
6.3. Judicial Jurisdiction: If a dispute is not resolved in a pre-trial procedure, it shall be subject to consideration exclusively in the judicial bodies of the Republic of Kazakhstan at the place of location of the Seller (in the courts of the city of Almaty), in accordance with the procedural law of the RK. The Buyer waives the right to apply to courts at their place of residence/location.
7. FORCE MAJEURE
7.1. The Parties shall be released from liability for non-performance of obligations in the event of force majeure circumstances (natural disasters, wars, sanctions, international embargoes, disruptions in the operation of the global Internet, or international payment systems).
